Many Americans, including 51-year-old Shepherd Hoehn, are under the impression that they have the First Amendment right to display whatever they want on their property or enjoy music regardless of its lyrics. The FBI and Department of Justice disagree.

Yesterday, Hoehn was sentenced to nearly four years in prison at an Indianapolis court for violating the Fair Housing Act and the unlawful possession of a firearm.

According to a criminal complaint filed by FBI special agent Chelsea Wesley, she began investigating Hoehn in June 2020 after his black neighbor called the local police over his display of a swastika with racial slurs on his fence and playing the Confederate anthem “Dixie” loudly.

Hoehn and the unnamed neighbor had previously had a dispute over the removal of a tree, but he did not threaten or engage in violence against the black man outside of one instance of throwing an egg at the black man’s house.

Hoehn was subsequently hauled in to be interrogated by the FBI when, according to agent Wesley, he told interrogators that the displays on his property were intended to protest the Black Lives Matter riots.

During the interview, he admitted that he did not like his black neighbor and that he intended to offend him too, but that he was painstakingly staying within the bounds of the First Amendment.

The FBI then raided his home on a highly dubious pretense and discovered that he was a firearm owner in possession of marijuana. They also claimed he had an open theft charge in Missouri from 1991.

Hoehn held that his 30-year-old theft charge was expunged after finishing his probation, but the FBI alleges in its original complaint that he was a “fugitive in possession of a firearm.”

Jewish federal prosecutor Josh Minkler, who ruthlessly pursued the case against Hoehn, appears to have dropped the fugitive charge during court proceedings, but settled on pressing him for the marijuana instead.

In a heartbreaking appeal on Twitter last year, Hoehn begged for a First Amendment to help him, writing, “I was expressing myself at my own home. I am NOT a criminal, I am merely an American exercising his freedom of speech…If that still exists in this country. […] Please someone… Anyone who can see the truth in the world…I am a nobody, with no power or money.”

Federal agents and prosecutors capitalize on the ignorance many have in relation to the use of marijuana as a gun owner. The law is only utilized when the government wants to punish people for political speech, as the liberal Huffington Post wrote last year when an Antifa member was prosecuted by a Trump loyalist under the statute.

Justin Coffman, the anarchist in question, was released from detention by a judge in Tennessee, who embarrassed the feds by telling them they were only hounding him for engaging in his First Amendment rights. While federal judges are eager to protect the rights of left-wing extremists, few uphold the same principle when the defendant is a white man who is critical of the status quo.

In a Justice Department press release on Hoehn’s guilty plea last February, the DoJ Civil Rights Division’s Pam Karlan angrily stated that the defendant’s “hateful and threatening conduct, motivated by racial intolerance, is an egregious crime that will not be tolerated by the Justice Department.”

FBI Indianapolis Special Agent in Charge Paul Keenan gave a more hysterical quote, “It’s unimaginable that harassment and intimidation such as this based on race, sexual identity or religious beliefs, still exists in this day and age. Such incidents are intended to create fear and will not be tolerated by the FBI.”

As Keenan aggressively pursued Hoehn, his office faced controversy when they failed to stop last April’s FedEx mass shooting, where nine people were killed. Keenan told the media that the FBI was warned by the gunman’s own mother that he was planning to go on a killing spree, but that his office lost interest in the young man when they found out during an interview that he did not hold any racist political beliefs.

As Merrick Garland’s FBI incentivizes agents to waste resources figuring out ways to arrest white people for political reasons, colossal failures like the aforementioned will be repeated.

So far in 2021, the FBI’s Indianapolis office has failed to prevent three high profile mass shootings. The city’s homicide rate, largely a product of black violence, has also now surpassed Chicago.

    Maybe “God Bless America” should be amended to “God Help America”.

It says more about the judge’s sick mentality than about the idiot he is now allowed to abuse. U.S. citizens are increasingly becoming victims of the insane far leftist judges that they have allowed to burrow into the court system over the last 60 years or so. I’m not knocking traditionally liberal judges, just the unbalanced and brainwashed ones on the far left we have so many of today. Their very existence in our lives is proof of the success the left has had in conquering the U.S. at every level that is of any consequence to Americans lives.

    When I was a very young boy around 1957 I noticed the police were next door and there was a heated discussion between the man who lived there and some neighbors over the swastika flag the neighbor had been flying on his flagpole. The police took the flag down. I asked my father about the incident since I often played with the neighbors youngest son and didn’t really understand what the swastika flag was about. Didn’t get a history lesson or the meaning of the first amendment just that this guy was being a jerk since WW2 was not that long ago and most of the men in the neighborhood were veterans of it.

    While 46 months in prison seems excessive this guy was being a real asshole and probably making life for everyone in the neighborhood unbearable not just the black neighbor. He won’t be missed.

    The Swastika flag is only offensive, because of the political narrative of the Hollow-co$t. The fact that it has been in use world wide for thousands of years is now irrelevant.

    So speaking of houses, does he own his house free and clear? Or does he have someone who can keep making the payments on it while he is in jail, including paying property taxes? If not, he will lose that house. And most likely his vehicles and all his possessions.

    That’s bullshit. Painting anything on someone else’s fence is vandalism and trespass.

    In a free society, what happened here was probably a matter for civil litigation, possibly grounds for a citation.

    Of course, that would be in a free society.

And the thing is, once you plead out, they’ve got your confession of guilt on the record — you are at their mercy. What if the judge decides to ignore the plea bargain and make an example out of you? They can do that, you know. Plea bargains are made with the prosecutor, not the judge. Judges usually go along with them, but they are absolutely not bound to do so.

    Did you realize that only 10% or so of people in prison ever made it through a jury trial? Everybody pleads out these days. A sword is held over your head, proverbially — “You can plead out for 40 months or we’re putting you on the hook for 10 years.” All that the prosecutors want is a conviction — that’s what advances their careers. They don’t actually want to go to jury trial. Neither do you, by the way, that’s a crapshoot. You don’t want that crapshoot with 10 years on the line — it’s wiser to swallow the 40 months. Only the very rich want juries; they can afford the outrageous fees of the top trial lawyers.

    Our justice system is a joke.

    ** BTW, St. Louis has now surpassed both Indianapolis and Chicago on the murder rates. St. Louis is now one of the top ten most dangerous cities on the planet, even surpassing most of the Mexican cartel-run towns. The country is falling apart, in case you haven’t been noticing.

    More to the point, since when does the FBI get to decide what it will or will not tolerate?

    It’s brief is to investigate various defined crimes and arrest the perpetrators if there is sufficient evidence. What it thinks of things otherwise is neither here nor there.

    What was the FBI specifically looking for? The search warrant should have described a specific thing or things they were looking for. The FBI should not be allowed to ransack someone’s dwelling in search of incriminating evidence just because they don’t like the subject’s political beliefs but that is what happened here.

    This is another case of the FBI weaponizing the law against white people who hold politically incorrect beliefs. Reverse the races and if the black man posted BLM flags on the white guy’s fence and blasted rap music the FBI would not have been involved and it would be up to the local yokel police dept. to sort out.

    This is a clear 4th amendment violation that should result in the termination of the FBI agents and the Jewish federal prosecutor. But then, we’re now living in a post Constitution America where politically incorrect whites have no civil rights.

    I can more or less remember the lyrics to “Dixie” (haven’t heard it performed in decades — is it now a hate crime?), and it is not a “Confederate anthem.” It’s a nostalgic song about loyalty to a region and subculture. But anything the wokesters don’t like brings the threat of prison.

    Hoehn’s sentence is absurdly, and frighteningly, extreme for offending someone. But I don’t have a lot of sympathy for him. His behavior was not very bright and seems to have been willfully obnoxious. There are better ways of using what’s left of the First Amendment.

    I have a HOA and they limit what I can have on my property so, while I can deny negroes entrance to my home, the HOA would not allow me to post a sign outside advertising my home as for “Whites Only”. I can donate to any political party or organization of my choice but I cannot festoon my property with the flags, symbols or posters of ANY political party or organization because the HOA doesn’t want to turn a residential community into a political squabble. We decide these things ( or used to) with elections.

    Comments like this say you accept the moral framing of the issue, you’re just quibbling over implementation and details. You can’t fight what we’re facing with this kind of half-measure mentality and moral uncertainty.

    What the FBI is doing is immoral to the core and what “this idiot” did was not immoral in any way. It’s not even clear what “idiotic” thing you’re damning him for.

My point is similar to advice given in one of the ageless books on wisdom, to wit, we must be clever as fox’s in dealing with our enemies while seeming gentle as lambs. The righteous are now in a weak position in the U.S. and the clearly evil, a word I seldom use but need to on this occasion, are being supported by billions of dollars from more evil people. What he was doing was advertising himself and putting a target on his back, when there are so many more effective ways of dealing with this evil, now so pervasive in this great country. I hope you see the spirit in which I wrote the post. Of course what happened to him was wrong. Of course the side of evil acted as was easily predicted. PEACE.
